These Terms and Conditions (“Terms”) govern your access to and use of the website and services offered by US Patriot Firearms (“US Patriot Firearms,” “we,” “our,” or “us”) through our website (the “Site”). By accessing or using the Site, you agree to be bound by these Terms and all applicable federal, state, and local laws. If you do not agree, you must not use the Site.

1. Eligibility

The Site and products sold through it are intended only for individuals who are legally eligible to purchase and possess firearms and ammunition under applicable law. By using the Site, you represent that you are at least 18 years of age or older where permitted by law and are not prohibited from possessing firearms or ammunition under federal, state, or local law.

2. Federal Age Requirements

Firearms & Ammunition

• 21 years or older – to purchase handguns and handgun ammunition.
• 18 years or older – to purchase rifles, shotguns, and rifle/shotgun ammunition, where legally permitted.

3. Account Registration

You may be required to create an account to access certain features of the Site. You agree to provide accurate, current information, maintain the confidentiality of your login credentials, and accept responsibility for all activity under your account.

4. Compliance With Laws

You are solely responsible for complying with all applicable federal, state, and local laws regarding the purchase, transfer, possession, and use of firearms, ammunition, and accessories. We reserve the right to cancel any order that violates applicable law or regulation.

5. Orders and Payment

Prices, availability, and product descriptions are subject to change without notice. Your order constitutes an offer to purchase; acceptance occurs only when we send an order confirmation. We reserve the right to refuse or limit any order at our discretion. You authorize us or our payment processor to charge your selected payment method for the total amount of your order, including taxes, shipping, and applicable fees.

6. Firearm Purchase & Shipping Requirements

• Federal law requires all firearms to be shipped to a valid Federal Firearms License (FFL) holder for transfer.
• You must select and confirm your receiving FFL prior to shipment.
• The receiving dealer must provide a valid signed FFL before shipment can be processed.
• Transfer fees and policies are determined by the receiving FFL.
• You will receive tracking information once your order ships.
• All firearm sales are final once the transfer is completed through your FFL.

7. Shipping & Delivery

• Orders are shipped via trackable carrier services where applicable.
• A signature from an adult (21+) may be required for delivery of firearms and ammunition.
• Risk of loss transfers to you once the shipment is delivered to the carrier.
• We only ship where legally permitted.

8. Returns & Cancellations

All sales are final. We do not accept returns or exchanges. Orders may be canceled only if they have not yet shipped. To request cancellation, contact us at [email protected]. Orders already processed or shipped cannot be canceled.

9. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of US Patriot Firearms or its licensors and is protected by applicable intellectual property laws. Content may be used for personal, non-commercial purposes only with prior written permission required for any other use.

10. User Content

If you submit reviews, comments, or other content (“User Content”), you grant US Patriot Firearms a non-exclusive, royalty-free, worldwide license to use, reproduce, and display such content. You agree not to submit unlawful, defamatory, obscene, or infringing material. We reserve the right to remove or edit User Content at our discretion.

11. Prohibited Conduct

You agree not to:

• Violate any applicable firearm or ammunition laws.
• Misrepresent your identity, age, or eligibility.
• Interfere with or disrupt the Site’s security or functionality.
• Use automated systems (bots, scrapers) without permission.
• Upload malicious code or harmful software.
• Infringe upon intellectual property or privacy rights.
• Harass, threaten, or harm others.

12. Safety Warnings

• Always use ammunition that matches your firearm’s specifications.
• Inspect firearms for obstructions before use.
• Use proper eye and ear protection when shooting.
• Store firearms and ammunition securely and separately from unauthorized users.
• Never handle firearms under the influence of drugs or alcohol.
• Exposure to firearm discharge may involve lead; wash hands thoroughly after handling and ensure proper ventilation.

13. Disclaimer of Warranties

The Site and all products and services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

14. Limitation of Liability

To the fullest extent permitted by law, US Patriot Firearms shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data. Our total liability for any claim shall not exceed the amount paid for the product giving rise to the claim.

15. Indemnification

You agree to indemnify and hold harmless US Patriot Firearms, its affiliates, and their respective officers, employees, and agents from any claims, damages, or expenses arising out of your violation of these Terms or misuse of the Site or products.

16. Termination

We may suspend or terminate access to the Site at any time, without notice, for conduct that we believe violates these Terms or applicable law.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Oklahoma, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Oklahoma, and you consent to jurisdiction in those courts.

18. Changes to These Terms

We may update these Terms at any time. Updates will be posted on this page with a revised “Effective Date.” Continued use of the Site after changes constitutes acceptance of the updated Terms.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

20. Entire Agreement

These Terms, along with our Privacy Policy and any additional posted policies, constitute the entire agreement between you and US Patriot Firearms regarding use of the Site.
